ElCom increases chargeable network costs in favour of the BKW

In its ruling of 15 April 2013 the Swiss National Electricity Commission ELCOM adjusted the chargeable costs of transmission networks in favour of the BKW. As a result, BKW can claim an additional CHF 3 million in charges for the use of their transmission network
On 6 March 2009 ELCOM issued a ruling on the 2009 costs and tariffs for the transmission network. Based on this ruling they reduced the chargeable grid costs of various transmission network owners - including BKW - as a result of which grid revenue for 2009 was reduced by CHF 7.6 million. BKW filed an appeal with the Swiss Federal Administrative Court and subsequently the Swiss Federal Supreme Court against this ruling.
The Swiss Federal Supreme Court partially approved BKW's appeal in its decision of 3 July 2012 and instructed ElCom to recalculate the chargeable grid costs for BKW. The Swiss Federal Supreme Court's decision led to the chargeable costs for the year 2009 being subsequently increased by approximately CHF 3 million.
On 15 April 2013 ElCom issued a new ruling based on the 2009 costs and tariffs for the transmission network, instructing Swissgrid to pay this amount to BKW, including interest on the difference.
