Challenge to resolutions of
shareholders´ meeting 2007

One of the company´s shareholders, Dr. Helms from Hanover, has requested the regional court in Hanover to enter judgement against the ordinary resolutions of this year´s shareholders´ meeting held on June 21st 2007. The lawsuit bears the reference number 26 O 84/07. The lawsuit was received on 27.07.07 and is based on an allegedly formal mistake concerning the report of the Supervisory Board.
Both Executive and Supervisory Board deem this lawsuit to be unsubstantiated. Neschen AG will take legal action to defend itself against the lawsuit.
However, the fact that this lawsuit has been submitted could have an effect on the share price.
