Leonardo Venture GmbH & Co. KGaA has filed the action for damages - as already announced - against the former general partner Leonardo Venture Capital GmbH and its former managing directors Prof. Dr. Köglmayr and Prof. Dr. Wupper-feld, as well as its current managing director Mr. Koop, with the District Court in Mannheim.
The filing of the action as of today´s date has taken place as the respondents had not reacted to the draft of the claim for damages dispatched on March 5, 2009. This draft granted them a statutory deadline of ten days to reach an out-of-court settlement of the matter.
The action for damages is the consequence of various breaches of duty by the management of the general partner, which the Supervisory Board of Leonardo Venture GmbH & Co. KGaA uncovered in the course of the 2008 business year. The claim is based on the joint and several liability of Leonardo Venture Capital GmbH and its managing directors; it comprises damages provisionally set at approximately 5 million euros.
